UPPER DARBY, Pa. - A woman accused of assaulting a stranger on a subway train in Philadelphia in front of other riders who a police officer said "should have done something."

Superintendent Timothy Bernhardt of the Mount Darby Police Department said officers were called to the 69th Precinct around 10 p.m. Wednesday after an attack on a westbound train on the Market-Frankford line.

A Pennsylvania Southeastern Transportation Authority employee who happened to be near a passing train called police to report that "something was wrong" with a woman on board, Bernhardt said.

SEPTA police officers waiting at the next stop saw the woman and arrested a man. They took the woman to the hospital.

Bernhardt called the victim an "unbelievably strong woman" who gave police a lot of information. He didn't know who attacked him, he said.

The entire incident was captured on surveillance video that shows other people on the plane at the time, Bernhardt said.

"There are a lot of people, in my opinion, who should have intervened; someone should have done something," said Bernhardt. "It speaks to where we are in society; I mean, who would let something like that happen? So it's a problem."

Fiston Ngoy, 35, has been charged with rape, assault and related offenses, according to Delaware court records. Bernhardt said SEPTA and Mount Darby police knew him.

"What we want is for everyone to have a sense of anger and resentment and a commitment to safety enforcement," SEPTA Police Chief Thomas J. Nestel III said at a news conference.

Nstel would not provide an approximate number of witnesses and it was not clear from the affidavit how many passengers were in the vehicle for 40 minutes. Authorities have not released the surveillance video.

"I can tell you that people were holding their phones where this woman was attacked," he said.

No calls were made to 911 in Philadelphia. Nstel said police are still waiting for Delaware County 911, which covered the last two train stops, to determine if any calls were received.

SEPTA issued a statement calling it a "scary post" and urged anyone who saw it to report it to authorities.

"There were other people on the boat who witnessed this bad behavior, and it could have been stopped sooner if a passenger had called 911," the agency said.
